Terms of Service

1. About Elite Assured

Elite Assured Consulting & Certification ("Elite Assured", "we", "us", or "our") is an ISO certification consulting firm providing advisory, documentation, training and liaison services to assist organizations in achieving ISO certification from IAF-accredited Certification Bodies.

Elite Assured is a certification consulting and facilitation service. We work with and coordinate with IAF-accredited Certification Bodies (CBs) to facilitate the certification process. The ISO certificates are issued by these accredited CBs, not directly by Elite Assured.

2. Services Provided

Elite Assured provides the following services:

• ISO certification consulting and advisory services
• Gap analysis against ISO standard requirements
• Documentation preparation (Quality Manuals, SOPs, Policies, Records)
• ISO awareness and internal auditor training
• Facilitation and coordination with accredited Certification Bodies
• Liaison support during certification audits
• Surveillance audit preparation and ongoing compliance support
• Certificate renewal and recertification support

3. Eligibility

Our services are available to:

• Registered businesses, organizations and legal entities
• Sole proprietors and professionals operating a legitimate business
• Individuals acting on behalf of a qualifying organization

We reserve the right to refuse service to any entity at our discretion, including organizations engaged in illegal activities or those misrepresenting their identity or business nature.

4. Client Responsibilities

As a client, you agree to:

• Provide accurate, complete and truthful information about your organization and operations
• Cooperate fully with our consultants and make required personnel available
• Implement required changes and corrections as advised by our consultants
• Pay fees as agreed in the service agreement
• Not misuse or misrepresent any ISO certificate obtained through our services
• Inform us immediately of any material changes to your business that may affect certification scope
• Maintain ongoing compliance with ISO standard requirements after certification

5. Fees and Payment

• Service fees are specified in the individual service agreement or quote provided to you
• Payment terms are as agreed in the service agreement
• Fees are non-refundable unless otherwise specified in writing
• GST and applicable taxes are additional to quoted fees
• Certification body audit fees are separate from Elite Assured consulting fees
• Delayed payments may result in suspension of services

6. Certification Outcomes

Elite Assured provides expert consulting to maximize your certification success. However:

• Certification decisions are made independently by the accredited Certification Body
• Elite Assured does not guarantee certification outcomes
• Non-conformities identified during audit must be addressed by the client
• If certification is not achieved due to client non-compliance, fees are not refundable
• Additional audit visits required due to major non-conformities may incur additional costs

7. Intellectual Property

• All website content, templates, training materials and documents created by Elite Assured are our intellectual property
• Documents we create for your organization as part of the service become your property upon payment
• You may not reproduce, distribute or resell our proprietary materials without written permission
• ISO standards are owned by the International Organization for Standardization (ISO) — Elite Assured holds no claim to ISO standards

8. Confidentiality

Both parties agree to maintain confidentiality of the other party's proprietary business information disclosed during the engagement. This obligation continues for 3 years after engagement completion. This does not apply to information that becomes publicly available through no breach of this agreement.

9. Limitation of Liability

To the maximum extent permitted by law:

• Elite Assured's liability is limited to the fees paid for the specific service giving rise to the claim
• We are not liable for indirect, consequential, or incidental damages
• We are not liable for certification decisions made by independent Certification Bodies
• We are not liable for business losses resulting from certification failure or delay
• We are not responsible for changes in ISO standards or accreditation requirements after service commencement

10. Termination

• Either party may terminate the service agreement with 30 days written notice
• Fees paid for work completed up to termination date are non-refundable
• Elite Assured may immediately terminate services for breach of these terms, non-payment, or fraudulent conduct
• Upon termination, all documents prepared for your organization are provided to you

11. Dispute Resolution

Any disputes arising from these Terms or our services shall be:

• First addressed through good-faith negotiation between the parties
• If unresolved within 30 days, submitted to mediation
• If mediation fails, subject to binding arbitration under Indian Arbitration and Conciliation Act, 1996
• Governed by the laws of India

12. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any legal proceedings shall be subject to the jurisdiction of courts in Rajasthan, India.

13. Amendments

Elite Assured reserves the right to modify these Terms at any time. Changes will be posted on our website with an updated effective date. Continued use of our services after changes constitutes acceptance. For existing service agreements, material changes will be notified in writing.
